KBH Global Terms of Use
Welcome to KBH Global.
KBH Global is a business information exchange community for users around the world. It mainly provides business information publishing, product supply and demand exchange, supplier and buyer discovery, business showcasing, business discussion, and related community and technical functions.
In these Terms of Use, “KBH Global”, “we” or “the Platform” refers to the independent operator that provides the KBH Global services to users. Users may contact the Platform operator through the official contact email address published on the KBH Global website.
These Terms of Use apply to the related services provided by KBH Global (collectively, the “KBH Services”), including the website, the mobile web version, and any official application and other service access points that KBH Global formally provides in the future.
Please read these Terms of Use before registering for, accessing or using the KBH Services.
By registering for, accessing or continuing to use the KBH Services, you agree to use the Platform in accordance with these Terms of Use and with the Community Rules and the Paid Services Rules that apply to the relevant functions.
The Privacy Policy and the Cookie Policy explain how KBH Global processes personal information and uses cookies and similar technologies. They do not automatically become commercial contractual commitments under these Terms merely because these Terms refer to them.
If applicable law gives you rights that cannot be waived or limited by contract, these Terms of Use do not exclude or limit those rights.
1. Nature of KBH Global
KBH Global is a community for publishing, exchanging, discovering, showcasing and discussing business information.
The KBH Services may include:
1) publishing product supply and demand information;
2) supplier and buyer discovery;
3) display of business information and product information;
4) business discussion areas;
5) user profile pages and public profile information;
6) global merchant showcase;
7) information organization functions such as Topics, Product Tags, search, categorization and recommendations;
8) AI-assisted functions;
9) reporting, content governance and community safety functions;
10) K Coin, and membership, display, promotion or other platform services provided by KBH Global itself;
11) other community or technical functions that KBH Global provides from time to time.
Some functions may be in testing, gradually rolled out, restricted by region, restricted by user eligibility, or not yet available.
Whether a particular function is actually provided is determined by the pages that users can actually access and use at the relevant time and by Platform announcements.
The mention in these Terms of any type of service that may be provided does not mean that the service is currently available, and does not constitute a commitment by KBH Global to provide that service in the future.
2. KBH Global Does Not Provide Transaction Services Between Users
KBH Global does not provide on-platform ordering, transaction settlement, funds custody, payment guarantee, inspection, logistics, customs clearance, contract performance or transaction protection services for transactions in goods or services between users.
Unless a particular service expressly states otherwise, KBH Global:
1) is not the buyer or seller in any transaction in goods or services between users;
2) is not a user’s agent, broker, trustee or transaction guarantor;
3) does not collect or hold transaction payments between users on their behalf;
4) is not responsible for the conclusion or performance of contracts between users;
5) is not responsible for the production, inspection, transport, delivery, customs clearance, after-sales service or refunds of goods.
After users obtain business information, discover other users or establish contact through KBH Global, any inquiries, quotations, negotiations, contract signing, payment, receipt of payment, production, purchasing, inspection, transport, insurance, customs declaration, import and export, handling of taxes and fees, delivery, returns and exchanges, after-sales service and other business activities that they carry out on their own are business activities conducted independently between the relevant users or third parties.
3. Business Risks Between Users
KBH Global does not comprehensively verify Platform users, merchants or the business information they publish, and does not guarantee the identity, legal status, credit, solvency, production capacity or ability to perform of any user or merchant.
Unless KBH Global expressly launches an independent verification service and clearly states the specific scope of that verification, accounts, global merchant showcase, paid displays, promotional placements, rankings, labels, country or region information and the like on the Platform do not constitute certification, recommendation, credit rating, guarantee or endorsement by KBH Global of the relevant users or merchants.
Content that is a paid promotion or paid display shall be labeled by KBH Global as “Promoted”, “Sponsored” or by other clear and reasonable means.
KBH Global does not guarantee the following information published or provided by users:
1) identity or legal status;
2) company, factory or business information;
3) credit or ability to pay;
4) production capacity or supply capacity;
5) authenticity of goods;
6) quality, specifications, quantity or safety of goods;
7) inventory;
8) prices;
9) certifications or licenses;
10) delivery times;
11) intellectual property status;
12) the legality of goods or transactions in the relevant countries or regions.
Users shall make their own judgments about, and verify, their transaction counterparties and business information, and shall, as appropriate in the circumstances, adopt written contracts, reliable payment methods, inspection, insurance and other reasonable risk control measures.
Fraud, misrepresentation, payment default, delivery default, product quality problems, discrepancies between samples and bulk goods, transport losses, intellectual property disputes, refund disputes or other transaction disputes arising between users shall, in principle, be resolved by the actual parties to the transaction themselves.
Users may report suspected fraud, scams, impersonation, illegal goods or other conduct that violates the Community Rules through the channels provided by KBH Global.
The taking of platform governance measures by KBH Global against relevant accounts or content does not mean that KBH Global becomes a party to the relevant transaction, nor does it mean that KBH Global bears transaction losses between users.
The provisions of this Section on business risks between users do not apply to errors in the platform services that KBH Global itself provides to users, such as K Coin accounting errors or a confirmed purchased platform service not being provided as agreed. Such issues shall be handled in accordance with these Terms, the Paid Services Rules and applicable law.
4. User Eligibility
KBH Global is, in principle, available only to users who are at least 18 years of age.
By registering for or using the KBH Services, you confirm that you are at least 18 years of age and have the capacity required by law to perform the relevant acts.
If you use KBH Global on behalf of a company, organization or other entity, you shall ensure that you are authorized to act on behalf of that entity.
Users must not use KBH Global to engage in activities that violate applicable law, export controls, sanctions regulations or that are otherwise prohibited by law.
5. Account Registration and Security
Users shall provide the information reasonably required to register for and use the Platform, and shall, as far as possible, keep that information true, accurate and valid.
KBH Global may provide email verification code, Google sign-in or other sign-in methods. The availability of third-party sign-in methods may depend on the relevant third-party services.
Users shall reasonably protect their accounts, login credentials and verification information, and must not sell, rent out, transfer or maliciously share their accounts.
If a user discovers that their account has been used without authorization, has been stolen or has other security problems, the user shall promptly notify the Platform through the official contact channel published by KBH Global.
Users shall bear responsibility in accordance with law for losses caused by their own intentional acts or by their failure to take reasonable account security measures.
6. User Content
“User Content” includes posts, replies, business discussions, product information, images, attachments, avatars, profile information, merchant information and other content that users publish, upload, submit, display or transmit on KBH Global.
Users, in principle, retain the rights in User Content that they enjoy under law.
In order to operate the KBH Services, users grant KBH Global a license, to the extent reasonably necessary to provide the relevant services, to store, copy, display, convert the format of, categorize, index, search, translate, technically process and distribute User Content.
This license is used only to provide, maintain, secure and reasonably improve the KBH Services and to enable the relevant functions that users use, and does not mean that KBH Global acquires ownership of User Content.
Unless otherwise expressly notified and any required authorization or consent has been obtained in accordance with law, KBH Global will not provide User Content to third parties for the purpose of training third-party general-purpose artificial intelligence models. Where User Content is processed by a third-party AI service provider as a result of the use of AI functions, the specific processing methods, the scope of data and information about the relevant third parties are as set out in the Privacy Policy and the relevant function descriptions.
Users shall ensure that the content they publish:
1) is content they have the right to publish;
2) does not infringe the copyright, trademark rights, patent rights, privacy rights or other lawful rights of others;
3) does not contain false, fraudulent or seriously misleading business information;
4) complies with the Community Rules;
5) complies with applicable law.
7. Business Discussion Areas
KBH Global may provide business discussion areas for users to exchange information and views relating to business, trade, purchasing, supply chains, products, industry experience and use of the Platform.
Content in the discussion areas is published by the respective users themselves.
Views, experiences, judgments or suggestions expressed by users do not represent the views, guarantees or professional opinions of KBH Global.
KBH Global is a business information exchange community, and its main purpose is not to provide discussion services on news, politics, religion or other public issues unrelated to the Platform’s business positioning.
The Platform may take management measures under the Community Rules against content that clearly deviates from the Platform’s positioning, affects normal business exchange or violates the rules.
8. Community Rules and Content Governance
All User Content and user conduct are subject to the Community Rules.
The Community Rules apply to, including but not limited to:
1) usernames;
2) avatars;
3) profile pages;
4) posts;
5) replies;
6) business discussions;
7) images and attachments;
8) product and supply and demand information;
9) global merchant information;
10) other content that users submit through KBH Global.
KBH Global may use human review, rule matching, automated tools or other reasonable means to detect and handle content that may violate the rules.
Depending on the nature and severity of a violation, the Platform may take measures including but not limited to:
1) requesting modification;
2) warnings;
3) hiding or restricting display;
4) deleting content;
5) restricting posting, replying or other functions;
6) suspending accounts;
7) terminating accounts;
8) canceling or removing the relevant displays;
9) other reasonable measures provided for in the Community Rules.
In cases of obvious illegality, serious fraud, major security risks, the safety of minors or other situations requiring immediate risk control, KBH Global may hide content or temporarily restrict relevant functions before completing its final review.
9. Reports, Responses, Appeals and Platform Decisions
KBH Global may provide reporting, response and appeal mechanisms.
Reporters shall describe the facts being reported and, depending on the nature of the report, provide true and relevant evidence.
Malicious reporting, fabricating evidence, knowingly submitting false information or using the reporting mechanism to maliciously attack other users may in itself constitute a violation of the Community Rules.
For cases that require a response from the reported user, KBH Global may provide the reported user with the necessary reported facts, the corresponding community rules and the relevant evidence that can reasonably be disclosed.
The Platform may redact, summarize or restrict the disclosure of personal information, sensitive information, information relating to the safety of the reporter or other information in the report materials that is not appropriate for direct disclosure.
Generally, a reported user has a response period of 72 hours after receiving the report notice to submit an explanation and relevant evidence.
If, due to time zones, the collection of evidence, technical failures or other reasonable reasons, the reported user is unable to complete the submission within the response period, the reported user may, before the period expires, request an appropriate extension of the response time. Whether to grant an extension, and the length of any extension, shall be reasonably decided by KBH Global based on the nature of the case and the actual circumstances.
The 72 hours is the response period during the handling of a report, and is not the same as the appeal period after the Platform has made an enforcement decision.
If the reported user does not submit materials within the response period, KBH Global may continue its review and make a decision based on the materials available at that time.
For content that presents an obvious, urgent or serious risk, the Platform may first take hiding, restriction or other temporary measures, and then give the relevant user an opportunity to respond.
KBH Global makes platform governance decisions based on the materials submitted by both parties, Platform records, the Community Rules and other reasonable evidence.
After the Platform makes an enforcement decision, the affected user may request a review or file an appeal within the period and in accordance with the procedures specified in the Community Rules.
The Platform shall notify the relevant users of the outcome through the notification methods it actually provides.
A user’s acknowledgment of receipt of a Platform decision only indicates that the relevant notice has been received. It does not mean that the user must agree with the decision, nor does it affect the implementation of platform governance measures that have been taken in accordance with law and the rules.
The specific procedures for reports, responses, appeals, reviews and enforcement are as set out in the Community Rules and the reporting system actually provided by the Platform.
10. Public Penalty Information
To improve the transparency of community governance and help users understand how the Platform’s rules are enforced, KBH Global may provide limited public penalty information for penalties for serious violations that meet the conditions specified in the Community Rules.
Public penalty information shall follow the principles of necessity, proportionality and relevance to the purposes of community governance.
Where the Platform has the corresponding functions and public disclosure is permitted by law, the public information may, in principle, include:
1) the username;
2) the number of the Community Rules provision violated;
3) the type of penalty;
4) the penalty period or current penalty status.
The Platform shall not disclose information unrelated to the purposes of community governance for the purpose of publicizing penalties.
Unless otherwise required by applicable law or there is another lawful basis, public penalty information does not, in principle, include:
1) the identity of the reporter;
2) email addresses, IP addresses or private contact details;
3) identity documents or other sensitive personal information;
4) the complete report evidence;
5) the content of private communications;
6) internal review materials;
7) detailed case facts that do not need to be disclosed to the public.
Public penalty information shall not use factual or personal allegations beyond the scope necessary for the Platform’s governance decision.
Where a penalty is revoked, the Platform shall promptly remove or correspondingly update the public penalty information.
The manner and period of public display after a penalty period expires are as specified in the Community Rules and in the public penalty mechanism actually provided by the Platform at the relevant time.
Ordinary warnings, general content modifications, deletion of individual items of content or other minor enforcement actions are, in principle, not entered in the public penalty record.
This Section does not mean that KBH Global has currently enabled any particular form of public penalty page.
The specific public penalty functions, scope of disclosure and procedures are as set out in the functions actually provided by the Platform, the Community Rules and applicable law.
11. Artificial Intelligence and Automated Functions
KBH Global may provide or use artificial intelligence, automated categorization, translation, content understanding, tagging, content safety or other automated technologies to assist in providing Platform functions.
These functions may include:
1) copy polishing;
2) title assistance;
3) content translation;
4) automatic Product Tag matching;
5) content categorization;
6) content safety assistance;
7) other similar functions that the Platform provides in the future.
Results generated, translated or otherwise processed with the assistance of AI may contain errors, be incomplete, be mistranslated or be inaccurate.
Before publishing, using or relying on the relevant results, users shall check them themselves as appropriate in the circumstances.
AI functions do not change the responsibility that users bear for the content they ultimately publish.
For governance decisions such as permanent account termination, deduction of K Coin, cancellation of important paid platform entitlements that have not yet expired, or other decisions with a significant adverse effect on users, KBH Global shall, in principle, provide human review. Where the law provides otherwise, applicable law shall apply.
Matters such as the data processing, third-party technical service providers and cross-border processing involved in AI functions are as set out in the Privacy Policy and the relevant function descriptions.
12. K Coin
K Coin is a service credit used within the KBH Global Platform.
Users may obtain K Coin through the different methods that KBH Global makes available at the relevant time, for example:
1) Platform activities;
2) user rewards;
3) official gifts;
4) top-up;
5) service compensation;
6) other methods that KBH Global makes available from time to time.
Whether a particular method of obtaining K Coin has been made available, and the specific amounts, conditions, restrictions and rules, are as set out in the information actually published at the relevant time on the relevant activity, function or service page.
Unless otherwise expressly provided by the Platform, K Coin:
1) is used only for designated platform services within KBH Global;
2) is not legal tender;
3) is not a bank deposit;
4) is not savings, securities, an investment or any other financial product;
5) does not bear interest or generate investment returns;
6) must not be used for transactions in goods or services between users;
7) cannot be withdrawn as cash;
8) must not be transferred, sold or used for settlement between users by users on their own.
KBH Global may, according to the different methods by which K Coin is obtained, record its source, acquisition, consumption, adjustment and other necessary accounting information.
The specific rules on K Coin consumption, accounting anomalies, activity rewards, top-up, reversal, refunds, compensation and other matters are as set out in the Paid Services Rules and the relevant activity rules.
13. KBH Global’s Own Services and Paid Services
KBH Global may provide membership, business showcasing, promotion and other platform services provided by KBH Global itself.
Whether a particular service is actually available is determined by the purchase, redemption or use page that users can actually access at the relevant time.
Functions that are not yet available, in testing or only at the planning stage do not constitute a commitment by KBH Global that it has provided that service to users merely because they are mentioned in these Terms.
For functions involving charges, K Coin redemption or other clearly specified service conditions, the price, the K Coin required, the service period, the specific entitlements and other important conditions shall be as actually displayed on the page when the user confirms obtaining that service.
Content that is a paid promotion or paid display shall, according to the actual function, be labeled as “Promoted”, “Sponsored” or by other reasonable means.
The platform services provided by KBH Global itself and the transactions in goods or services that users conduct between themselves are different relationships.
Erroneous deductions of K Coin, a service not taking effect, abnormal interruption of a service or other problems with the Platform’s own services that occur when users use KBH Global’s own services are not subject to the provisions of these Terms under which users bear the risks of business transactions between users themselves, and shall instead be handled in accordance with these Terms, the Paid Services Rules and applicable law.
14. Service Changes, Maintenance and Interruptions
KBH Global may adjust, suspend or discontinue certain functions for maintenance, security, upgrades, data migration, vulnerability fixes, service improvements, legal compliance or other reasonable reasons.
For major maintenance or service changes that can reasonably be foreseen and may have a significant impact, the Platform may notify users in advance to the extent reasonably practicable.
For platform services that a user has already obtained and that have a clearly specified service period, KBH Global shall not, during that service period and without reasonable grounds, substantially reduce the confirmed core service content.
If a confirmed platform service cannot be provided normally for a prolonged period for reasons attributable to KBH Global itself, reasonable remedies shall be taken in accordance with the Paid Services Rules, the specific service conditions and applicable law.
KBH Global does not guarantee that the services will be permanently uninterrupted or completely error-free, or that any data can be recovered in all circumstances.
However, this Section does not release KBH Global from any responsibility for data security, platform services or other matters that it bears under applicable law and that cannot be excluded by law.
15. Force Majeure and Third-Party Service Failures
Where the services cannot be provided normally due to natural disasters, war, serious public events, government actions, changes in law or regulation, large-scale failures of power, communications or internet infrastructure, or other events beyond the reasonable control of KBH Global, the relevant obligations may be reasonably suspended to the extent and for the period actually affected.
KBH Global will take measures to the extent reasonably practicable to reduce the impact and restore the services.
Where cloud services, data centers, DNS, email services, third-party sign-in, AI service providers or other third-party technical services fail, KBH Global will take reasonable measures to handle the situation based on the actual circumstances.
A third-party service failure does not automatically constitute force majeure, nor does it automatically release KBH Global from the responsibility it bears under law for the platform services that it has itself confirmed it will provide.
For security incidents such as cyberattacks, DDoS, malicious intrusions, zero-day vulnerabilities and supply chain attacks, responsibility shall be determined based on the nature of the incident, the reasonable security measures taken by KBH Global and applicable law, and not all security incidents are automatically treated as force majeure.
Where force majeure, a third-party failure or a security incident affects a time-limited platform service that has already been obtained, it may be handled, depending on the nature of the event, the scope of impact, its duration and applicable law, by restoring the service, extending the service period, reissuing the corresponding service time, adjusting K Coin, providing a refund or other reasonable means.
16. Data Anomalies and Data Recovery
KBH Global may take reasonable backup, security and disaster recovery measures, but does not promise that all ordinary User Content can be stored permanently, will not be lost in any circumstances or can be fully recovered.
For business materials that users consider important, users are advised to keep their own copies.
The above principles do not directly apply to accounting anomalies affecting K Coin, orders or platform entitlements that have already been obtained.
If there is a data inconsistency affecting K Coin, orders or platform entitlements, KBH Global shall carry out a review based on verifiable transaction records, orders, Platform records and the relevant supporting documents that the user can provide, and, after confirming an anomaly, make a reasonable correction or provide an appropriate remedy.
KBH Global shall not, solely on the basis of a final balance after an anomaly occurred or the result displayed by a single system, automatically exclude other accounting evidence that can be reasonably verified.
In the event of a data security incident involving personal information, KBH Global will take the necessary investigation, containment, remediation and notification measures according to the nature of the incident, the level of risk and applicable law.
17. Intellectual Property
The name, logo, interface design and platform code of KBH Global, and other content that belongs by law to the Platform or the relevant rights holders, are protected by applicable intellectual property laws.
Without authorization, users must not copy, impersonate, maliciously use or otherwise infringe the relevant rights.
Users must not use KBH Global to publish counterfeit product information, misappropriate images, impersonate brands or companies, or publish content that infringes the copyright, trademark rights, patent rights or other lawful rights of third parties.
Where a rights holder believes that Platform content infringes its lawful rights, it may submit a complaint through the contact channel published by KBH Global and provide the materials reasonably required to identify the relevant rights, the allegedly infringing content and the complainant.
KBH Global may, based on the complaint materials, the explanation of the user complained against, Platform records and the applicable rules, take reasonable measures such as restricting display, deleting content, requesting additional materials or restricting accounts.
Maliciously submitting false intellectual property complaints, forging proof of rights or using the complaint mechanism to maliciously attack other users may also constitute a violation of the Community Rules.
18. Account Restriction, Suspension, Termination and Deletion
Where a user violates these Terms of Use, the Community Rules, the Paid Services Rules or applicable law, KBH Global may take corresponding measures based on the nature and severity of the violation, the number of repetitions and the related risks.
Measures may include warnings, deleting or restricting content, restricting certain functions, suspending accounts, restricting business displays or terminating accounts.
In cases of serious fraud, illegal activities, major security risks, malicious evasion of Platform penalties, repeated serious violations or other situations requiring immediate risk control, KBH Global may directly take higher-level restriction measures without being required to impose penalties step by step.
The specific method by which a user may delete their account is as determined by the account deletion function actually provided by the Platform or the official contact channel.
After an account is deleted or terminated, the Platform may stop publicly displaying the related profile information.
For public posts, replies or discussion content that has already been published, the Platform may delete, anonymize or otherwise appropriately handle such content based on the nature of the content, the integrity of discussions, user requests and applicable law.
For information that must be retained by law or where retention is genuinely necessary, such as information relating to orders, K Coin accounting, security, fraud, reports, appeals, disputes and intellectual property complaints, KBH Global may retain such information on a restricted basis for the necessary period.
The specific manner in which personal information is processed is as set out in the Privacy Policy.
After an account is restricted, suspended, terminated or deleted, unused K Coin and platform entitlements that have not yet expired are not automatically forfeited in full merely because of the change in account status, and shall be handled in accordance with the Paid Services Rules and applicable law.
19. Limits of Responsibility
KBH Global will, to a reasonable extent, maintain the normal operation, security and basic service capability of the Platform. However, internet services may be affected by network conditions, devices, software, third-party services and other factors.
To the extent permitted by applicable law, KBH Global does not make absolute guarantees as to the following:
1) that the services will always be continuous, completely error-free or permanently available;
2) that all User Content will be stored permanently;
3) that all third-party services will always operate normally;
4) that information published by users is completely true, accurate or complete;
5) that users will successfully reach business cooperation with each other;
6) that transactions between users will be performed normally;
7) that the results of AI, automatic translation, automatic categorization or other automated processes will be completely accurate.
Losses relating to product quality, payment for goods, payment, delivery, transport, customs clearance, contract performance, fraud, refunds or other losses arising from business transactions that users conduct between themselves shall, in principle, be borne by the actual parties to the transaction in accordance with law.
The above limits of responsibility must not be used to release KBH Global from the responsibility it bears under law for the platform services it itself provides.
No disclaimer or limitation of liability applies to liability that applicable law expressly provides cannot be excluded or limited, including liability for fraud, intentional misconduct and gross negligence that cannot be exempted by law, personal injury, and the mandatory rights that consumers enjoy under law.
20. Third-Party Services and External Links
Some functions of KBH Global may rely on third-party sign-in, email, cloud infrastructure, AI, machine translation or other third-party technical services.
The relevant third-party services may be subject to their own terms of service and privacy policies.
KBH Global may replace, add or stop using a particular third-party service provider for reasons such as security, service quality, technical changes, cost, legal requirements or other reasonable reasons.
User Content may contain links to third-party websites, applications, contact details or other external resources.
Unless expressly stated by KBH Global, these third-party resources are not controlled by KBH Global, and do not represent any recommendation, certification or guarantee by KBH Global of the relevant third parties, goods, services or content.
21. Platform Notices
KBH Global may send the following through on-site messages, the user’s registered email address, page prompts, announcements or other reasonable methods actually provided by the Platform:
1) account and security notices;
2) notices of reports, responses, appeals and penalties;
3) service change notices;
4) policy update notices;
5) K Coin or platform service notices;
6) other important information directly related to the user’s use of the KBH Services.
Users shall, as far as possible, keep their registered email address valid and reasonably check important notices relating to their accounts.
Where the law requires a specific method of notice, applicable law shall apply.
22. Modification of These Terms of Use and Related Rules
KBH Global may make reasonable modifications to these Terms of Use and the related rules in light of changes in Platform functions, community governance, security requirements, laws and regulations, third-party services or the operating model.
Policy pages shall display the version, effective date or last updated date.
Modifications that involve only textual corrections, formatting, translation improvements or that do not substantively affect users’ rights and obligations may be updated directly.
Important modifications that may substantively affect users’ rights and obligations may be notified in advance through on-site notices, the registered email address, login prompts or other reasonable methods.
Where applicable law requires consent to be obtained again, KBH Global will act in accordance with the relevant requirements.
Platform services that have already been obtained and have a clearly specified period shall, in principle, be performed under the service conditions that applied when the user obtained that service, unless the law requires otherwise or the parties have agreed otherwise.
23. Language Versions
KBH Global may provide versions in English, Simplified Chinese, Traditional Chinese, Vietnamese, French and Arabic.
The Platform will make reasonable efforts to keep all language versions consistent in meaning with respect to the structure of the provisions, numbering, definitions, rights, obligations and rules of responsibility.
Each language version shall be provided to the relevant users in a complete, accurate and understandable manner.
If there is any inconsistency between language versions arising from translation, the English version shall serve as the reference for interpretation to the extent permitted by applicable law.
The use of the English version as the reference for interpretation does not exclude or limit the rights that users enjoy under applicable mandatory law and under the law of the place where they are located.
24. Governing Law and Dispute Resolution
KBH Global serves users in different countries and regions.
These Terms of Use and the platform service relationship between KBH Global and users shall be interpreted and handled in accordance with the law that applies by law in the specific circumstances.
These Terms of Use do not exclude or limit the rights that users enjoy under mandatory law that applies by law and cannot be excluded by contract.
Where a problem arises between a user and KBH Global in relation to the services provided by the Platform itself, the parties shall first try to resolve it through communication via the official contact channel published by the Platform.
If it cannot be resolved through communication, it may be handled, in accordance with the law that applies by law, by a court or arbitral institution with jurisdiction or by other dispute resolution methods permitted by law.
Disputes arising from transactions in goods or services that users conduct between themselves shall be resolved by the actual parties to the transaction themselves in accordance with their transactional relationship, contractual agreements and the law that applies by law.
KBH Global does not assume the role of arbitrator, adjudicator or transaction guarantor for business disputes between users.
25. Contact
Users may contact the Platform through the official contact email address published on the KBH Global website regarding use of the Platform, accounts, reports and appeals, privacy requests, intellectual property complaints, K Coin or platform service anomalies, security issues and other matters relating to the KBH Services.
Unless otherwise required by law, KBH Global currently uses the official contact email address published on its website as its single public contact channel.
26. Survival After Termination and Miscellaneous
After an account is deleted or terminated, or a user stops using the KBH Services, the provisions that by their nature should remain in effect shall continue in effect, including:
1) the limits of responsibility for transactions between users;
2) intellectual property;
3) retention of data and accounting records that is necessary under law;
4) limits of responsibility;
5) dispute resolution;
6) other provisions that by their nature should remain in effect.
If any provision of these Terms of Use is held invalid, unenforceable or subject to limited interpretation under applicable law, this shall, in principle, not affect the continued validity of the other provisions.
Any failure by KBH Global to immediately exercise a right under these Terms does not constitute a permanent waiver of that right.
The headings in these Terms are for convenience of reading only and shall not on their own be used to expand or narrow the meaning of any specific provision.
The Community Rules and the Paid Services Rules respectively set out further provisions on community governance and platform service matters.
The Privacy Policy and the Cookie Policy respectively explain how personal information and cookies and similar technologies are processed.
If these Terms of Use conflict with mandatory provisions that must apply by law, the relevant mandatory provisions shall prevail.
